The People’s Democratic Party (PDP) has chosen the territory of the federal capital, Abuja, as the location of its national convention scheduled for October 30 and 31, 2021.

“NEC will meet on September 9 to approve the various nominations within the respective national committees of the convention. “

Earlier on Saturday, the struggling party’s national chairman wrote to acting chairman Elder Yemi Akinwonmi to decide on the NEC meeting.

CinemaCon is the convention for movie theater owners and the last time they hosted an event was in March 2019. The 2021 tax bill released proposed to introduce a tax on the retirement interest of those who cease their South African tax residency. This means that a new article will be inserted in the income tax law which will come into force on March 1, 2022. The exit tax may very well lead to the double taxation of pension interest, and this goes to the against the network of double taxation treaties entered into by the South African government.

Countries enter into Double Taxation Agreements (DTAs) to encourage economic activity, prevent tax evasion and, most importantly, prevent double taxation. Double taxation occurs when two countries impose a tax on the same person for the same purpose. DTAs aim to avoid this by assigning taxing rights, which will determine which country has the right to tax the income in question. Where both countries have the right to tax the income, the DTA will require the country of residence to grant a tax credit for foreign taxes paid.

In the context of pensions and similar amounts, the CDI would generally give the country of residence the sole right to tax. This is where the problem comes in as the proposed exit tax creates a fiction, where it treats the person as having withdrawn from the applicable fund the day before their cessation of residence, creating a South African tax liability. By conceiving it this way, the exit tax effectively subverts the DTA, which we’ll get to in a moment.

The problem for the taxpayer arises when he actually withdraws his retirement interest at a later date. When that time comes, they will likely have become residents of their new country of residence, which the DTA says will then be able to tax that amount based on their national tax laws. The result is that pension interest is taxed in both countries.

Normally, the DTA will then relieve the taxpayer by requiring the country of residence to grant a tax credit for foreign (South African) taxes incurred. However, since the South African tax did contravene the provisions of the DTA, the new country of residence would not be required to provide such credit.

Does the exit tax prevail over the DTA?

According to the Organization for Economic Co-operation and Development (OECD), a treaty waiver is “the adoption of a law that aims to unilaterally cancel the application of obligations under an international treaty”.

The proposed tax on the deemed withdrawal of South African pension interest from expatriates ceasing their tax residency in South Africa fits this description. This seems to be perfectly understood by the Public Treasury, which in its Explanatory Memorandum on the exit tax brazenly declares that “[t]The application of a tax treaty between South Africa and the new country of tax residence can, in certain cases, lead South Africa to lose its tax rights.

In other words, the new provision appears to be designed specifically to subvert the DTA, thereby overriding the network of DTAs entered into with other countries.

The gravity of this decision cannot be underestimated. It is important to understand that once a DTA has been approved by both Houses of Parliament and published in the Official newspaper, it becomes part of South African law; it is fully binding.

But the DTA is not the only international agreement at risk of being violated. South Africa is bound by the Vienna Convention on the Law of Treaties, which states in article 18 that [a] The State is bound to refrain from any act which would run counter to the object and purpose of a treaty… ” The purpose of a CDI is to avoid double taxation. If South Africa enacts a provision that results in double taxation, it defeats the purpose of the ITA and, by extension, also violates the Vienna Convention.

The status of treaties in our law is complex and subject to differing opinions, but there are those who believe that treaty obligations have the same force as the Constitution. That is, they occupy the highest possible rank. If this point of view is accepted, disregarding a permanent contract, as proposed by the exit tax, would be unconstitutional.

Either way, the decision of the National Treasury to pass legislation that nullifies its treaty obligations is of great concern.

Public comment

This is a new measure implemented entirely to the detriment of taxpayers departing from South Africa. It is not clear whether this is intended to serve as an intentional deterrent or simply to raise additional income, but it is an unprecedented political decision.

The Expat Tax Petition Group, along with Tax Consulting South Africa, will submit proposals to Parliament to advocate against the introduction of this amendment.

The Bastiats, et al, claim to want more ideological purity, although it is difficult to discern that in their own ranks, populated as they are by a mangy coalition of milquetoast libertarians, Bible fanatics and conspiracy theorists. Qanon still fooled into thinking the 2020 election was stolen.

What binds these people together is not a common ideology, but the resentment of the “establishment” (and, in Becker’s case, a heavy but so far largely unrequited political ego).

At the polls, this confederation of dunces is a non-factor. However, in the most picturesque surroundings of party politics, they are a puzzle, and this worries some NDGOP leaders.

So much so that there is serious talk of skipping the State Party’s approval agreement next year.

It does not mean that it is something that is going to happen, only that serious people with influence in the party are talking about it.

Why would they do such a thing?

Because if the Bastiats, etc., etc., are not likely to move the needle in the ballot box, they are able to put enough cigarette butts in the seats of a congress to embarrass the party. They control local leadership in around 16 legislative constituencies.

These districts could accommodate a lot of delegates ready to boo, say, Representative Kelly Armstrong and Senator Hoeven for voting to certify the 2020 election results.

They could boo Governor Burgum, who is not on the ballot this cycle but would be forced to speak at the convention like the former governors did.

They might boo Senator Kevin Cramer, also on the ballot but also obliged to speak, for having voted for the recent bill on infrastructure.

Some NDGOP leaders are worried about these mortifying possibilities, and they should be.

KATMANDU: The Nepalese Congress (NC) faction led by top leader Ram Chandra Poudel highlighted the 14th General Convention being held on schedule.

Members of the NC Central Working Committee (CWC), close to senior leader Poudel, held a meeting at the residence of Secretary General Shashank Koirala in Maharajgunj on Monday afternoon to discuss the party’s 14th general convention.

Leaders supported keeping the general convention on schedule by finalizing disputes and proceedings at the meeting. CN’s 14th General Convention is scheduled for September 1-4. Leaders believe the convention should be held on time even though it would cost less to shorten proceedings and end disputes.

CN called a meeting of the CWC on August 12 to discuss the matter. The Poudel faction held a meeting today ahead of the party’s CWC meeting. Senior leader Poudel said talks were held to save the party’s legitimacy by holding a general convention on time.

This project took me two and a half years. It is 6 feet wide and 23 feet long. First of all, I must thank all the donors who made this construction possible. Your contributions have allowed me to make this dream come true. Due to the circumstances surrounding the completion of this build, you will all be remembered in a separate video. Then I want to thank everyone who helped complete this build at the very end. My original plan was to finish this build at home, record all the necessary videos, take photos, and then finally exhibit it at the Brick Rodeo LEGO convention. Unfortunately, construction was not completed until the very last day of the Lego convention. As such, I only had one day to take full advantage of this MOC. I have had a lot of help from many great friends to whom I am forever indebted for their kindness and support.

This project portrays almost every scene from the Starkiller base in The Force Awakens. It was a project I knew I wanted to do, the moment I saw The Force Awakens in theaters. This was a unique project, in that it incorporated a large set of minifigures, tons of fully lit interior rooms, mountains, large snow landscapes, and a forest, all in one build. I have been tasked with designing so many different types of structures for this build, and I hope the effort will show through this final video.

CHITWAN: Nepalese Congress (NC) General Secretary Dr Shashanka Koirala said it was not possible to hold the party’s 14th General Convention on schedule.

The party has set its general convention for August 30, which it says is not possible.

Speaking to reporters in Chitwan on Friday, he said the General Convention on time was not possible due to disputes over the party’s active membership and other lingering issues.

He added that the Convention will be held in November-December settling internal issues.

The dispute over active party members erupted before preparations for the General Convention.

He was of the opinion that the question of party membership should be addressed one year before the date set for the General Convention.

“We want the General Convention as soon as possible,” he said.

According to him, he also announced his candidacy for the presidency of the party. Others, two establishment party candidates aspire to compete for the post and we will lose the battle if we all fight for the post and discussions are underway to forge a consensus to file a single candidacy.
